International Litigation and Arbitration (one credit)

Addresses the issues and problems that arise in the transborder resolution of commercial disputes and contract claims. The course examines the use of municipal courts and arbitral tribunals to address these conflicts.
Investment Arbitration - NAFTA (one credit)
11:15 a.m. - 1:15 p.m. • Professor Bachand
A study of a novel form of transborder arbitration that applies to the mixed disputes of international trade. The considerations focus upon NAFTA Chapter 11 arbitral proceedings.
SECOND SESSION (May 23 - June 3)
Dispute Resolution in WTO (one credit)
9:00 a.m. - 11:00 a.m. • Professor Nanda
Assesses the role of non-judicial adjudication in the resolution of trade disputes that arise in the context of the World Trade Organization (WTO).
Consumer Arbitration (one credit)
11:15 a.m. - 1:15 p.m. • Professor Saumier
Examines the U.S. and Canadian law on the use of class action remedies and arbitration in the context of consumer disputes. Recent High Court cases from each jurisdiction are compared.
THIRD SESSION (June 4 - June 13)
ICSID Arbitration (one credit)
9:00 a.m. - 11:00 a.m. • Professor De Mestral
Another arbitration system, like NAFTA, that addresses the issue of sovereignty in resolving transborder commercial and investment disputes. ICSID was established under the Washington Convention as the World Bank's arbitration facility for mixed investment disputes. It has become a key arbitration system with the proliferation of Bilateral Investment Treaties (BITs), which give foreign investors the right to claim against a host state.
ICC Arbitration (one credit)
11:15 a.m. - 1:15 p.m. • Professor Gélinas
Examines the structure and practices of a major provider of arbitration services. The International Chamber of Commerce, headquartered in Paris, France, administers more than 600 arbitrations yearly. It therefore has a significant impact upon transborder arbitral practice.
