The Code of Federal Regulations (CFR) is a subject arrangement of 50 titles containing the final rules and regulations of the federal agencies. The CFR is updated by the CFR List of Sections Affected and the Federal Register.

HYPOTHETICAL:

The Department of Transportation regulates the establishment of "time zones" in United States. You have recently been alerted to the discussion about the time zone boundary lines being re-drawn in the State of Indiana. You need to determine the status of this possible boundary change. Where would you look to see if DOT has made any changes to the "time zone" boundaries?

STEP 1

CONSULT THE CURRENT CFR INDEX AND FINDING AIDS

  • The Index cites to parts, not to sections within the parts.

STEP 2

LOCATE THE CFR PART IN THE MOST RECENT REVISED EDITION OF THE CFR
  • The CFR set is published every year, but titles are issued at different times during the year.
  • Titles 1 - 16 revised January 1
  • Titles 17- 27 revised April 1
  • Titles 28 - 41 revised July 1
  • Titles 42 - 50 revised October 1
  • Titles are further divided into parts and sections.

  • Consult the Table of Contents for each part to determine the appropriate sections of the part.

STEP 3

DETERMINE IF ANY CHANGES HAVE BEEN MADE TO THE CFR USING THE LSA: LIST OF CFR SECTIONS AFFECTED

  • LSA: LIST OF CFR SECTIONS AFFECTED is published monthly and is a cumulative listing of changes to the CFR volumes.

  • The changes are arranged by CFR title.

  1. Consult the most recent monthly pamphlet of LSA: LIST OF CFR SECTIONS AFFECTED to determine if changes have been made to the CFR

    • The most current LSA pamphlet contains changes from the current CFR edition through the end of the month indicated on the LSA front cover.

    • Consult the LSA title page for the dates of coverage for each CFR title.

    • Locate the CFR title, part, and section in the LSA.

  2. Refer to the "table of Federal Register issue pages and dates" at the back of the LSA to determine which FEDERAL REGISTER issue contains the text of the change.

  3. Locate the FEDERAL REGISTER issues containing the changes.

STEP 4

DETERMINE IF ANY CHANGES HAVE BEEN MADE TO THE CFR SINCE THE MOST RECENT LSA ISSUE USING THE FEDERAL REGISTER

  • The FEDERAL REGISTER, published every business day, is the chronological arrangement of the federal agency rules and regulations.

  • It contains Presidential documents, new final regulations, proposed regulations, and notices.

  • The contents of the FEDERAL REGISTER are in order by type of document beginning with the final regulations.

  • The FEDERAL REGISTER is continuously paginated throughout the year.

  1. Consult the "List of CFR Parts Affected" in the last issue of each month of the FEDERAL REGISTER from the date of the most recent LSA to today's date.

    • The "List of CFR Parts Affected" is a cumulative list of parts and sections of the CFR that have been changed during the particular month.

    • The List begins on the first page of the "Reader Aids" material at the back of each FEDERAL REGISTER issue.

  2. Refer to the "Federal Register pages and date" chart to determine which Federal Register issue contains the change.

    • The Chart is located at the bottom of the first page of the "Reader Aids" material at the back of the FEDERAL REGISTER issue.

  3. Locate the FEDERAL REGISTER issues containing the 2006 final rules and proposed rules for Part 71.5.

PENNSYLVANIA CODE
AND
PENNSYLVANIA BULLETIN

The Pennsylvania Code, a multi-volume looseleaf set, is the subject arrangement of the rules and regulations of Pennsylvania agencies. The Pennsylvania Code is updated by the Pennsylvania Bulletin.

QUESTION:
As the attorney for the Penn National Racetrack , you must keep abreast of regulations issued by the State of Pennsylvania Gaming Commission. Recently there has been a large number of "temporary regulations" issued by the Gaming Commission, you need to make sure that Penn National complies with all regulations "temporary" or final. At this time you know that final regulations will be issued soon, and you want to compare the final regulations with the "temporary" to insure that Penn National is preparing to comply or is already in compliance.

STEP 1

CONSULT THE GENERAL INDEX AT THE END OF THE SET OR THE TITLE INDEX FOR THE TITLE COVERING YOUR AGENCY

There is a "Master Index" covering all titles within the set. However, it is much faster to use the index at the end of each title, because it is specific to the title, and it is updated more frequently.

STEP 2

LOCATE THE TITLE AND CHAPTER IN THE APPROPRIATE VOLUME

  • Titles are divided into chapters.
  • The Pennsylvania Code is updated on a monthly basis.
  • Look at the date at the bottom of the page to determine when the page was updated.
  • To determine the coverage of the last update received, consult the "Transmittal Sheet" at the front of the binder. In titles that have multiple binders the "Transmittal Sheet" is placed in the front of only the first binder for the title.
  • The closing date on the "Transmittal Sheet" indicates the latest issue of the Pennsylvania Bulletin included in the Pennsylvania Code.

STEP 3

DETERMINE IF ANY CHANGES HAVE BEEN MADE TO THE PA CODE VOLUME USING THE PENNSYLVANIA BULLETIN

  • PENNSYLVANIA BULLETIN is published weekly and issued on Saturday.
  • It contains changes to the regulations, Governor's executive orders, changes to Pennsylvania court rules, notices, and other documents authorized by law.
  • Issues are paginated consecutively throughout the year.
  • A cumulative index is published quarterly.
  • Each issue contains a cumulative "List of PA Code Chapters Affected" by new, proposed, or amended regulations during the current calendar year. It does not list notices.

  1. Refer to the cumulative "List of PA Code Chapters Affected" from the closing date listed on the transmittal sheet to the present to find changes to the regulations.

  2. Look at the Table of Contents for each issue from the closing date listed on the transmittal sheet to the present for notices. For this example, you would need to look at the Table of Contents in each issue beginning with October 21, 2006 through May 19, 2007. (This would be 32 issues.)
